A man is facing Possession of a Weapon by a Previous Offender charges after accidentally sitting on his gun and shooting himself in the crotch.

I think natural consequences, or karma, often sufficiently punish the person doing something wrong. A perfect example of this is a man who recently shot himself in the genitals. He had been getting in his car and accidentally sat on his gun, setting it off. Now, he may be facing charges for Possession of a Weapon by a Previous Offender charges – as if he hasn’t suffered enough.

Definition of Douglas County, Colorado Possession of a Weapons by Previous Offender Charge

The Colorado law definition of Possession of Weapons by Previous Offenders – C.R.S. 18-12-108 – is:

“

A person commits the crime of possession of a weapon by a previous offender if the person knowingly possesses, uses, or carries upon his or her person a firearm as described in section 18-1-901 (3) (h) or any other weapon that is subject to the provisions of this article subsequent to the person's conviction for a felony, or subsequent to the person's conviction for attempt or conspiracy to commit a felony, under Colorado or any other state's law or under federal law.”

Anytime a person who has a Douglas County, Colorado felony conviction carries a firearm or other weapon, they are subject to this charge. The man above had a felony for drugs on his record, so by admitting in his statement that he sat on his gun, he opened himself to the Possession of a Weapon by a Previous Offender charge.

Sentence for Possession of Weapons by a Previous Offender in Castle Rock or Highlands Ranch

Possession of Weapons by a Previous Offender can be charged as a class 5 or class 6 felony in Castle Rock or Highlands Ranch. It is a class 5 felony if the person possesses, uses, or carries a dangerous weapon, or if the original conviction was for Burglary, Arson, or another crime that involved a deadly weapon. Possession of a Weapon by Previous Offender is a class 6 felony if none of the aggravating circumstances apply.
