Castle Rock Forgery Attorney | Real Estate Broker Charged with Forgery and Theft

Three people were arrested and charged with Forgery and Conspiracy to Commit Forgery after forging bank statements for a real estate fraud.

Real Estate Broker Charged with Forgery and Theft
Forgery is charged in Castle Rock, Highlands Ranch, and Parker when a person illegally creates or alters an official document. Three people involved in the real estate business were recently arrested for Forgery and Theft after it was discovered they were using forged bank statements to deceive an elderly woman into selling two duplexes she owns. The bank statements were used to convince the woman that one of the trio had enough money to pay cash for the houses – which they convinced her to sell to them at a value well below what it was worth. Each of the three was arrested and charged with Theft, Conspiracy to Commit Theft, Forgery, and Conspiracy to Commit Forgery.

Douglas County Forgery Lawyer: Definition of Forgery in Real Estate

The Douglas County, Colorado law definition of Forgery – C.R.S. 18-5-102(1)(c) – is:

“

(1) A person commits forgery, if, with intent to defraud, such person falsely makes, completes, alters, or utters a written instrument which is or purports to be, or which is calculated to become or to represent if completed:

(c) A deed, will, codicil, contract, assignment, commercial instrument, promissory note, check, or other instrument which does or may evidence, create, transfer, terminate, or otherwise affect a legal right, interest, obligation, or status;”

Because the trio falsified a document that was supposed to represent the amount of money one of them truly held in their accounts, they are facing the Forgery charge. Conspiracy to Commit Forgery was charged because the three planned and agreed to falsify the document in order to scam the woman. Even if it was only one person who actually changed the document, the fact they all agreed to it gets them charged with Conspiracy. Conspiracy to Commit Forgery is charged at the same felony level as the underlying Forgery charge.

Sentence for Forgery and Conspiracy to Commit Forgery in Castle Rock and Highlands Ranch

In Castle Rock and Highlands Ranch, Forgery is a class 5 felony, which is punishable by 1 to 3 years in the Colorado Department of Corrections and up to $100,000 in fines. Conspiracy to Commit Forgery is charged as a class 5 felony as well. If found guilty on both counts, a judge could run their sentences concurrently (at the same time) or consecutively (back to back), meaning a maximum of 6 years.
