Allowing a child to be placed in danger is charged as Child Abuse in Castle Rock and Douglas County. This type of investigation began after emergency personnel were called to a mother’s residence and her 21-month-old son was found dead at the hands of her boyfriend. The boyfriend admitted to having a temper and hurting the boy. Medical reports revealed old scars and injuries, beyond just what had killed the baby. While the boyfriend was charged with Murder, the mother is also facing Child Abuse charges for her role in the boy’s death.

“

A person commits child abuse if such person causes an injury to a child's life or health, or permits a child to be unreasonably placed in a situation that poses a threat of injury to the child's life or health”

Due to the marks and scars found on his body, it was assumed the mother knew her boyfriend was hurting her son. By leaving her child in his care, she was placing him in a situation that posed a threat of injury to her son’s life.

This crime is charged as a felony or misdemeanor depending on intent and injury:

When a person acts knowingly or recklessly and the child abuse results in death to the child

Class 2 felony

When a person acts with criminal negligence and the child abuse results in death to the child

Class 3 felony

When the person acts knowingly or recklessly and the child abuse results in serious bodily injury

Class 4 felony

When the person acts knowingly or recklessly and the child abuse results in an injury other than serious bodily injury

Class 1 misdemeanor

When the person acts with criminal negligence and the child abuse results in any injury other than serious bodily injury

Class 2 misdemeanor

When the person acts knowingly or recklessly and no injury results

Class 2 misdemeanor

When the person acts with criminal negligence and no injury results

Class 3 misdemeanor

She would be charged with the class 3 felony Child Abuse, as her negligence in leaving her children with her boyfriend resulted in the baby’s death.
