Kidnapping Attorney Near Me in Castle Rock | Woman Trying to ‘Save’ Boy from Being Kidnapped Charged with Attempted Kidnapping for the Ordeal 

A woman was charged with Attempted 2nd Degree Kidnapping after grabbing a boy from his father, in an attempt to save him. She claims she thought he was being kidnapped.

Taking anyone from one place to another without their permission is charged as Kidnapping in Castle Rock and Douglas County. A father and son were walking to school recently when they experienced an Attempted Kidnapping. According to the report, a woman approached the two and tried to grab the 5-year-old boy, asking him if he was okay and telling him he wasn’t with his father. The dad punched the woman and continued to take the boy to school and she followed them, yelling that the man was kidnapping her son. A police report was filed and the woman was found when she showed up at a fire department claiming she had been punched. She reported that she was just trying to stop a kidnapping.  

Douglas County Kidnapping Lawyer: Definition of Second Degree Kidnapping  

The Douglas County, Colorado law definition of Second Degree Kidnapping – C.R.S. 18-3-302 – is: 

“

(1) Any person who knowingly seizes and carries any person from one place to another, without his consent and without lawful justification, commits second degree kidnapping.

(2)  Any person who takes, entices, or decoys away any child not his own under the age of eighteen years with intent to keep or conceal the child from his parent or guardian or with intent to sell, trade, or barter such child for consideration commits second degree kidnapping.”

Because the woman only tried to take the boy, but was not successful, she is facing Attempted 2nd Degree Kidnapping. 

Criminal Attempt in Highlands Ranch and Parker: How Does It Change the Kidnapped Charge? 

In Castle Rock, Highlands Ranch, and Parker, 2nd Degree Kidnapping is a class 4 felony, which is punishable by 2 to 6 years in the Colorado Department of Corrections.  Under C.R.S. 18-2-101 – Criminal Attempt is defined as:

“

A person commits criminal attempt if, acting with the kind of culpability otherwise required for commission of an offense, he engages in conduct constituting a substantial step toward the commission of the offense.”

Trying to take the boy would definitely be considered a substantial step. Criminal attempt to commit a class 4 felony is a class 5 felony in Colorado, so, the woman would be facing 1 to 3 years in DOC for the class 5 felony.
