Fourth degree arson in Douglas County, Colorado is a crime that involves putting someone or property in danger with a fire. Ranging from a misdemeanor to a felony, 4th degree arson is an especially serious allegation. Starting or maintaining a fire that spreads elsewhere is a common situation that could result in fourth-degree arson charges. With Douglas County fire restrictions often in place, law enforcement is especially sensitive to situations that might include arson. Douglas County 4th Degree Arson Law

Douglas County’s arson laws prohibit fires that pose a threat to property or people. CRS 18-4-105 describes the specific violations of arson in the fourth-degree in Colorado. You commit this crime in Castle Rock, Parker, or Sedalia if you:

  • knowingly or recklessly,
  • start or maintain a fire or cause an explosion,
  • that places another person in danger of injury or death,
  • or places any building or occupied structure in danger of damage

It is particularly important to note that this is the only degree of arson that doesn’t require property damage. Even minor threats to others or property can be enough to result in criminal charges. In situations where firefighters respond to the fire, 4th degree arson can be charged based on putting them in danger as well.

What’s the Sentence for 4th Degree Arson in Colorado?

The penalties for this arson offense depend on the specific facts of each unique case. When property is at risk that is worth less than $100, a class 3 misdemeanor applies. A conviction here can lead to a maximum of 6 months in county jail and fines of $50 – $750. If the property is worth $100 or more, a class 2 misdemeanor often results. Sentencing parameters include:

  • up to 1 year in county jail,
  • a maximum fine of $1,000

However, when a fire or explosion places people in danger, a class 4 felony applies. This can lead to 2 – 6 years of incarceration and a minimum fine of $2,000.
