Using another’s credit card without permission can lead to an unauthorized use of a financial device charge in Douglas County, Colorado. This is a type of credit card fraud that can apply to using a stolen credit card, one that you found, or a friend’s card without their authorization. Unauthorized use of a financial device can also apply to debit cards as well.

Colorado’s credit card fraud laws prohibit attempts to defraud the card holder, a seller, or a credit card company. CRS 18-5-702 addresses unauthorized credit card use throughout Douglas, Arapahoe, and Elbert County. You commit this offense if with intent to defraud you:

  • use a credit or debit card without authorization,
  • to obtain cash, credit, property, services, or to make a payment

Even using an expired or canceled credit card for the above reasons can lead to criminal charges. Furthermore, a charge of criminal possession of a financial device can apply in situations where the card isn’t used but you keep it knowing it’s lost, stolen, or was delivered to you by mistake.

Credit card fraud charges are also closely related to identity theft, especially when personal or financial identifying information is used.

How Bad is Credit Card Fraud in Douglas County?

Unauthorized use of a financial device ranges from a petty offense to a felony, depending on the value of the fraud itself. When values are under $300, a petty offense applies which can result in a county jail sentence and a maximum fine of $300. Values of $300 – $1,999 are a misdemeanor offense. A conviction in these cases can lead to:

  • up to 364 days in county jail,
  • a max fine of $1k

Credit card fraud involving $2,000+ is a felony throughout Colorado. It is important to note that multiple acts of credit card fraud within a 6 month timeframe are added together as one offense, causing the total figure to add up quickly.
