Douglas County DWAI Law

Douglas County’s DWAI law prohibits driving when you’re less able to do so safely due to alcohol or drug consumption. CRS 42-4-1301 provides specific elements of driving while ability impaired throughout Colorado. Someone commits DWAI in Lone Tree, Castle Pines, or Larkspur if they:

  • drive a motor vehicle,
  • while impaired by alcohol or one or more drugs,
  • or by a combination of the two

How Bad is a DWAI in Castle Rock?

A first-time DWAI in Douglas County is a misdemeanor and can come with a brief county jail sentence, as well as fines of up to $500, 48 hrs of community service, and 8 DMV points. A second or third DWAI in Colorado typically results in a mandatory jail sentence, higher fines, and more hours of community service. However, a fourth DWAI or DUI is a class 4 felony and can lead to years in prison, fines of $2K – $500K, and 3 years of parole.
