  • perform sexual acts in public (oral, anal, or vaginal sex),
  • expose an intimate body part intending to arouse or satisfy someone’s sexual desire,
  • lewdly fondle or grope another person,
  • or knowingly expose your genitals in an alarming way that scares or offends another

Acts of genital exposure that are meant to satisfy sexual desire are typically charged as the more serious crime of indecent exposure. Intimate parts refer to the breast, butt, anus, and pubic area.

Public Indecency Penalties in Douglas County

Consequences of public indecency in Colorado largely depend on prior offenses. As a first-time exposure crime, public indecency is a petty offense. This can result in up to 6 months in county jail and fines of up to $500. However, if a defendant has a prior conviction of a closely related crime, the new offense is a class 1 misdemeanor. As many as 18 months in county jail and thousands in fines can result. Sex offender registration only applies if the offense is your second within 5 years or third within your lifetime.
