Third-degree assault charges in Colorado typically stem from someone inflicting bodily injury on another. This can be done knowingly, recklessly, or with criminal negligence. Injuries in this offense aren’t serious but do include physical pain, cuts, scratches, and bruises. Earlier this month, a former sheriff’s sergeant was arrested in Colorado after allegedly using excessive force with a Taser on a combative inmate. Douglas County Third-Degree Assault Law

Douglas County’s third-degree assault law prohibits wrongfully injuring someone. CRS 18-3-204 provides the details of assault in the third degree throughout Colorado. You commit this offense in Castle Rock, Parker, or Highlands Ranch if you:

  • knowingly or recklessly hurt another person,
  • or injure someone while using a deadly weapon with criminal negligence

The officer’s other charge of official misconduct involves a public servant using their authority to harm someone. This applies to any state, county, city, or federal government employee.

What are the Penalties for Third-Degree Assault in Douglas County?

While each 3rd degree assault case is different, this type of assault is a class 1 misdemeanor throughout Colorado. Third-degree assault is also an extraordinary risk crime, increasing the potential jail time. Defendants in these cases face:

  • 6 – 24 months in county jail,
  • fines of $500 – $5,000

An assault conviction can also lead to job termination or suspension for those in certain roles. As for official misconduct, this offense is often a class 2 misdemeanor, carrying up to 12 months in county jail and a maximum fine of $1,000 for conviction.
