In Castle Rock and Douglas County, Domestic Violence is a sentence enhancer attached to any crime when the alleged victim is or has been in an intimate relationship with the accused. A man is facing some Domestic Violence charges after taking out his anger over a sports game on his girlfriend.  According to the report, the man got mad while watching March Madness and began to push and hit his girlfriend. On top of that, she claimed he would not let her leave the house. She was eventually got away and called 911. The man was arrested and charged with False Imprisonment and Third Degree Assault both as an act of Domestic Violence. 

Douglas County Third Degree Assault Attorney: Definition of 3rd Degree Assault  

The Douglas County, Colorado law definition of Assault in the Third Degree – C.R.S. 18-3-204(1)(a) – is: 

“

(1)  A person commits the crime of assault in the third degree if: 

(a)  The person knowingly or recklessly causes bodily injury to another person or with criminal negligence the person causes bodily injury to another person by means of a deadly weapon"

As a class 1 misdemeanor extraordinary risk crime, 3rd Degree Assault is punishable by 6 to 24 months in the Douglas County Jail. 

Definition of False Imprisonment in Highlands Ranch and Parker 

The Douglas County, Colorado law definition of False Imprisonment – C.R.S. 18-3-303 – is: 

“

Any person who knowingly confines or detains another without the other's consent and without proper legal authority commits false imprisonment. This section shall not apply to a peace officer acting in good faith within the scope of his or her duties.” 

False imprisonment is a class 2 misdemeanor, but can be charged as a class 5 felony if: 

  • The person uses force or threat of force to confine or detain the other person; and 
  • The person confines or detains the other person for twelve hours or longer. 

Based on the facts provided in the story, the man would likely be facing the class 2 misdemeanor charge, which is punishable by 3 to 12 months in the Douglas County Jail. 

Domestic Violence in Castle Rock and Douglas County 

When the Domestic Violence sentence enhancer is added to Assault or False Imprisonment, is means added requirements if convicted. A mandatory protection order will be entered and Domestic Violence treatment is required.
