Defining Menacing in Colorado
Colorado’s menacing law prohibits threatening verbiage or actions. CRS 18-3-206 provides the specific elements of both misdemeanor and felony menacing in Douglas, Arapahoe, and El Paso County. Menacing charges can follow if law enforcement believes you:
- by any threat or physical action,
- knowingly placed or tried to place another person,
- in fear of imminent serious bodily injury
If you’re accused of using a deadly weapon or something that resembles one in addition to the above actions, the offense becomes a felony. This can include use of firearms, knives, bats, clubs, metal tools, or in some instances, even your fists.
Will You Go to Jail for a Menacing Conviction?
