Leaving the scene of an accident (or hit and run) is a traffic offense in Douglas County, Colorado that can lead to especially significant consequences. C.R.S. 42-4-1601 defines the circumstances of a hit and run throughout Colorado’s cities, towns, and counties. A person commits this traffic crime when they:

  • are involved in a traffic accident,
  • and leave the scene without fulfilling lawful obligations (exceptions below)

Such obligations include notifying law enforcement of the collision, providing practical aid to anyone that is injured, and remaining at the scene of the accident. The only exceptions to remaining at the scene include departure to lawfully report the accident to law enforcement, hitting an unoccupied vehicle (other obligations apply), and if you are seriously injured and require immediate medical assistance.

What is the Penalty for a Hit and Run in Douglas County?

The three main factors that impact the potential consequences of a hit and run are whether anyone was in the other vehicle, the damage done to the other vehicle or property, and injury. The level of offense ranges from a class 2 misdemeanor all the way up to a class 3 felony. Hitting an unoccupied vehicle, causing property damage, or a traffic accident resulting in non-serious injury are typically misdemeanor offenses. Ramifications can include up to 12 months in county jail and also fines of up to $1,000. However, leaving the scene of an accident where serious bodily injury or death occurs is a felony. Consequences can include over a decade in the Colorado Department of Corrections, as well as six-figure fines.
