Invasion of Privacy for Sexual Gratification

Taking intimate photos or video of another without their knowledge or permission is unlawful throughout Douglas, El Paso, and Teller County. Whether done via a smartphone camera or nanny cam, defendants in these cases face jail time, fines, and sex offender registration. This offense has specific elements to it that must have occurred for a conviction to result. What Does Invasion of Privacy for Sexual Gratification Mean in Colorado?

Colorado criminal law prohibits observing or taking pics of someone’s private parts without their knowledge and permission. CRS 18-3-405.6 provides the definition of this offense in Colorado Springs. Police will pursue charges if they believe you:

  • knowingly observed or took a picture / video,
  • of another person’s intimate parts without their consent,
  • for the purpose of sexual gratification

It’s important to note that in order for this to be a crime, it must be done somewhere the subject of the picture or video has a reasonable expectation of privacy. Changing rooms, locker rooms, and restrooms are examples that meet this requirement.

Consequences of Invasion of Privacy for Sexual Gratification Conviction

As of March 1st, 2022, misdemeanor invasion of privacy for sexual gratification is no longer an extraordinary risk crime. As a class 1 misdemeanor, defendants in these cases face:

  • up to 12 months in county jail,
  • fines of up to $1K,
  • sex offender registration (can petition for removal after 5 years)

However, if the defendant has been convicted for unlawful sexual behavior before or the subject of the material was 14 or younger, a class 6 felony applies. This can lead to up to 18 months in prison, much higher fines, and double the period of sex offender registration.
