When a parent in Castle Rock or Douglas County, Colorado realizes their young child is missing, panic ensues. Even after being told what really happened, the parents were outraged when the man was not arrested and they took to Facebook – posting his picture and calling him a Kidnapper and Sexual Predator. Many people today will harm a good person to get the attention which drama provides them. So, is the lesson that we shouldn’t help those in need for fear that our motives will be misinterpreted?

Douglas County Colorado Kidnapping Lawyer: What is the Definition of 2nd Degree Kidnapping?

Provided that the parents’ accusations were believed by police and there were no witnesses to back the good Samaritan’s story, things would be very different. In that case, he could have been facing Second Degree Kidnapping charges if this had occurred in Douglas County, Colorado. The Colorado law definition of 2nd Degree Kidnapping – 18-3-302 (2) – is:

“

(2) Any person who takes, entices, or decoys away any child not his own under the age of eighteen years with intent to keep or conceal the child from his parent or guardian or with intent to sell, trade, or barter such child for consideration commits second degree kidnapping.

Second Degree Kidnapping Sentence / Punishment in Castle Rock

Second Degree Kidnapping is a serious felony that carries a mandatory sentence for a crime of violence. As a class 4 felony crime of violence in Castle Rock, Highlands Ranch, and Parker, the extended sentencing range is 4 to 12 years in the Colorado Department of Corrections. If the child was also a victim of Sexual Assault, as the parents claimed, then the charge would have been a class 2 felony crime of violence, punishable by 16 to 48 years in DOC.
