Douglas County’s Ban on Sale of Medical and Recreational Marijuana

While the state of Colorado has legalized the use and possession marijuana to those 21 and older, there are still many restrictions in place, and it isn’t always legal to purchase or sell cannabis. Each town and county has the right to vote on whether or not medical and/or recreational marijuana is sold within it’s boundaries, as well as specific rules for that county. For example, in the state of Colorado it is legal for a person over 21 to cultivate 6 cannabis plants, which would mean in a house with 3 adults, you could have 18 plants. However, within Douglas County, a max of 12 plants are allowed per household. Douglas County is one of many, including Elbert, Weld, and Lincoln County, that bans businesses from selling both recreational and medical marijuana.

In El Paso County, medical marijuana can be sold, but recreational marijuana is still restricted. After a lengthy investigation of 8 stores that were “all issued cease and desist notices to ‘stop the illegal practice of selling marijuana in a retail environment’” back in October, a warrant was issues for four individuals, as well as the residence of one in El Paso County (KRDO). At the home, police discovered with over 60 handguns and rifles in multiple safes in the garage, 6 of them had been stolen. Also discovered were cocaine, methamphetamine, and ecstasy, along with multiple vehicles and jewelry that were all confiscated.

Penalty for Selling Marijuana Within the Douglas County Jurisdiction

If you are caught selling marijuana for recreational or medical purposes in Parker, Lone Tree, or anywhere in Douglas County, you will be considered in violation of county Ordinance No. O-012-003. This ordinance prohibits the “Operation of Marijuana Cultivation Facilities, Marijuana Production Manufacturing Facilities, Marijuana Testing Facilities, or Retail Marijuana Stores within the unincorporated boundaries of Douglas County, state of Colorado.” For breaking this ordinance you can be charged with high fines at $1,000 per violation, and each day will be considered a separate violation.
