A man was recently charged with Possession of Marijuana with the Intent to Distribute after he was caught with a pound of weed in his car, while taking a driver’s license test. According to the report, the examiner smelled the marijuana while giving the test and alerted the police. When the car was searched, police found a pound of marijuana, a scale, over $15,000 in cash, and a loaded gun. I mean, you couldn’t find anywhere to store your contraband while you took your car for a driver’s test? If this had occurred in Colorado, the amount of pot in his possession would constitute a crime and he would have been charged.

 The Douglas County, Colorado law definition of Possession of Marijuana with Intent to Distribute – C.R.S. 18-18-406(2)(b)(I) – is: 

It is unlawful for a person to knowingly dispense, sell, distribute, or possess with intent to manufacture, dispense, sell, or distribute marijuana or marijuana concentrate; or attempt, induce, attempt to induce, or conspire with one or more other persons, to dispense, sell, distribute, or possess with intent to manufacture, dispense, sell, or distribute marijuana or marijuana concentrate.”

Having a pound of marijuana generally raises suspicion that the person is planning to sell some, but combined with a scale and large amounts of cash – I don’t think police would question the intention.
