While recreational marijuana is legal in Douglas County, Colorado, there are still laws that regulate its possession and sale. If someone isn’t careful with how much marijuana they have, who they give it to, or risk driving while high, significant criminal penalties can result. C.R.S. 18-18-406 defines most of the elements of Colorado’s marijuana laws. Regarding possession, someone commits a crime if they:

  • possess, transfer, or transport,
  • more than the legally permissible amount of marijuana,
  • or possess marijuana under the age of 21

It is important to note that the regulations regarding how much a person can purchase at one time include 1 ounce of marijuana flowers, 8 grams of concentrate, or 800 mg of edibles. Additionally, any amount of marijuana in National Parks and other federal properties is prohibited.

In regards to selling marijuana, someone commits an offense if they:

  • sell marijuana,
  • AND aren’t authorized to do so in Colorado

Will I Go to Jail for Marijuana Possession in Douglas County?

The punishments for possessing more marijuana than the legal amount often depend on whether it was personal use or sale and the amount and type. On the lower end, possession of less than 2 ounces of marijuana is a petty offense, possibly resulting in a small fine.

However, as the quantity grows so do the consequences. For example, possession of more than 12 ounces of marijuana or 3+ ounces of marijuana concentrate can result in a class 4 felony. Potential penalties include up to 12 months of incarceration, as well as up to $100,000 in fines.

Unlawfully selling marijuana is more serious and can come with harsher penalties. Selling pounds of marijuana without authorization or any amount more than a pound to a minor 2 or more years younger is a serious felony offense. Decades in the Colorado Department of Corrections, as well as six-figure fines can apply at sentencing.
