A woman was charged with Shoplifting Theft after switching regular priced items with clearance tags and paying only a few dollars for $1,000 worth of electronics.

Shoplifting Theft is charged in Castle Rock and Douglas County when a person takes something from a store without paying for it. This can include not paying the appropriate listed amount. A woman was recently charged with Shoplifting Theft after taking $1,825.20 worth of electronics and switching their tags with clearance item tags. She them went through the self-checkout line and scanned the clearance barcodes to pay a total of $3.70 for all the items. The woman was caught and arrested for Shoplifting Theft.

Douglas County Shoplifting Lawyer: Definition of Theft

The Douglas County, Colorado law definition of Theft, as it relates to Shoplifting – C.R.S. 18-4-401(1)(a) – is:

“

(1) A person commits theft when he or she knowingly obtains, retains, or exercises control over anything of value of another without authorization or by threat or deception; or receives, loans money by pawn or pledge on, or disposes of anything of value or belonging to another that he or she knows or believes to have been stolen, and:

(a) Intends to deprive the other person permanently of the use or benefit of the thing of value;”

By not paying the full price for the items, the woman used deception to get the items, with the intent of never giving them back.

Sentence for Theft in Highlands Ranch and Parker

In Highlands Ranch, Parker, and Castle Rock, Theft can be charged as a petty offense, misdemeanor, to felony depending on the value of the items taken:

  • If the value of the items is less than $50, it is a petty offense;
  • If the value of the items is $50 – $299, it is a class 3 misdemeanor;
  • If the value of the items is $300 – $749, it is a class 2 misdemeanor;
  • If the value of the items is $750 – $1,999, it is a class 1 misdemeanor;
  • If the value of the items is $2,000 – $4,999, it is a class 6 felony;
  • If the value of the items is $5,000 – $19,999, it is a class 5 felony;
  • If the value of the items is $20,000 – $99,999, it is a class 4 felony;
  • If the value of the items is $100,000 – $999,999, it is a class 3 felony;
  • If the value of the items is $1,000,000 or more, it is a class 2 felony.

The woman above would be facing the class 1 misdemeanor Theft crime.
