3 Things to Know About a Probation Violation in Douglas County

Probation Violation in Douglas County
Probation Violation in Douglas County

Probation violations in Douglas County, Colorado are often reported when someone fails to meet their terms and conditions of probation. Typically, a hearing is scheduled to determine if the violations should result in probation being taken away and the person be sent to jail.

Winning a probation violation hearing can help someone avoid additional jail time. Having a skilled defense attorney representing you during probation revocation hearings is always wise and can positively impact the outcome.

Probation Violation Hearings in Castle Rock

Probation Violation Hearings C.R.S. 16-11-206 are serious proceedings that determine whether a person’s probation should be revoked, altered in some way, or remain as is. Violating your conditions, failing to report for probation, or being arrested for another crime can all result in your probation officer (PO) reporting to the court.

Depending on the seriousness of the violation and the restrictions in place, a PO can choose to:

  • discuss the violation with the individual,
  • issue a summons,
  • or have the person arrested and taken to court

Reports of failing to meet conditions of probation can also be made by those in the community aware of the situation, family / friends, an employer, or the victim of the offense.

Probation Conditions in Douglas County

Certain conditions are in place for those on probation in Castle Rock, Parker, and Highlands Ranch. A written statement is given to the probationer that specifically states actions that are prohibited. While a great deal of these depend on the defendant’s prior criminal history and the offense itself, some common items include:

  • not committing any other offenses during the probation period,
  • paying victim restitution,
  • not harassing, intimidating, or tampering with victims or witnesses,
  • complying with substance abuse testing and treatment,
  • complying with certain restrictions if the crime was a sex offense

It is important to note that terms and conditions can include many other expectations and restrictions, especially those involving domestic violence or sex crimes.

Douglas County Probation Violation Attorney

There is a lot on the line in any probation revocation hearing and particularly skilled representation is a must. A strategic defense attorney can respond to evidence against you and perhaps argue witness statements aren’t reliable.
