Castle Rock Unlawful Sexual Contact Lawyer | Massage Parlor Under Investigation for Groping Claims

A spa chain is under investigation because more than 180 women have accused staff members of groping and Unlawful Sexual Contact.

Massage Parlor Under Investigation for Groping Claims
Groping or touching someone else’s intimate parts without permission will be charged as Unlawful Sexual Contact in Castle Rock and Douglas County. Recently, the spa chain Massage Envy has come under fire over 180 women have reported being victims of Unlawful Sexual Contact and Harassment by employees while receiving services. According to the report, the women claimed that they were groped during massages and that other lewd acts were performed during their services. If this had occurred at a Castle Rock or Highlands Ranch Massage Envy Spa and the alleged victim reported to the Douglas County Sheriff, the masseur would likely be facing Unlawful Sexual Contact charges.

Douglas County Unlawful Sexual Contact Attorney: Definition of Unlawful Sexual Contact

The Douglas County, Colorado law definition of Unlawful Sexual Contact – C.R.S. 18-3-404 – is:

“

(1) Any actor who knowingly subjects a victim to any sexual contact commits unlawful sexual contact if:

(a) The actor knows that the victim does not consent; or

(b) The actor knows that the victim is incapable of appraising the nature of the victim's conduct; or

(c) The victim is physically helpless and the actor knows that the victim is physically helpless and the victim has not consented; or

(d) The actor has substantially impaired the victim's power to appraise or control the victim's conduct by employing, without the victim's consent, any drug, intoxicant, or other means for the purpose of causing submission;”

Based on the information provided, likely some of the women were touched on their intimate parts, like breasts or buttocks, while getting a massage. They must have felt this contact was not part of the massage, but instead a violation.

Sentence for Groping Unlawful Sexual Contact in Parker and Highlands Ranch

As an extraordinary risk class 1 misdemeanor in Castle Rock, Parker, and Highlands Ranch, Unlawful Sexual Contact is punishable by 6 to 24 months in the Douglas County Jail and up to $5,000 in fines. Unlawful Sexual Contact is also a sex offense, so a conviction will require a period of registering as a sex offender.
