Douglas County 2nd Degree Assault

Douglas County’s second-degree assault law prohibits specific acts that result in another person’s injury. CRS 18-3-203 is the criminal code that addresses 2nd degree assault throughout the state of Colorado. You commit this crime in Highlands Ranch, Castle Rock, or Parker if you:

  • intentionally cause injury with a deadly weapon,
  • recklessly cause serious injury with a deadly weapon,
  • purposefully cause someone’s physical or mental impairment,
  • use physical force against police, firefighters, or EMTs or try to infect them using bodily fluids,
  • or injure another by suffocating or strangling them

Second-degree assault also applies in situations where someone is drugged without their consent.

How Serious is Second-Degree Assault in Douglas County?

Each assault case is unique. Penalties for a conviction differ from case to case. Assault in the second-degree is at minimum a class 4 felony throughout Colorado. Ramifications for defendants can include:

  • a prison sentence of 2 – 6 years,
  • fines of $2K – $500K

However, in situations where a deadly weapon was involved, the prison sentence range increases to 5 – 16 years.
