Perhaps the most frequent situation of prohibited use of weapons is the consumption of alcohol alongside firearm possession. Unfortunately, charges can come about even if the gun isn’t in use. Access to the weapon itself may be enough to qualify as unlawful when someone is drunk or high.

As a first-time violation, prohibited use of a weapon is a misdemeanor in Douglas County. Conviction can lead to as much as 364 days in county jail, as well as up to $1,000 in fines.

However, if a prior conviction (within the last 5 years) of unlawfully carrying a concealed weapon or prohibited use weapons exists, a class 5 felony applies. Possible ramifications include 1 – 3 years in a Colorado prison, as well as up to $100,000 in fines.
