Public Indecency Lawyers in Douglas County, Colorado and Misunderstandings about the Crime

Public Indecency (C.R.S. 18-7-301) is charged in Douglas County for many different reasons. Often, we see people worried about their future when they are facing charges for any criminal matter. However, this crime carries with it some incorrect and misplaced fears. Although, there is misinformation going around, rest assured, our criminal defense attorneys in Douglas County, Colorado know how to help. In this blog, I will discuss what Public Indecency is, what the consequences are, and answer some general misunderstandings about this law.

What is the Definition of Public Indecency in Douglas County, Colorado?

Public Indecency is essentially defined as when someone performs a sexual act in public. Yet, sex in public is not the only potential charge for this crime. You could also be charged for exposing your intimate parts in public. An intimate part is basically the breasts, butt, or other genital area of any person. Though, in order to be a crime, the exposure has to be done to satisfy a person’s sexual desire. But, if you are exposing your genitals, you could ultimately face charges of Indecent Exposure. Indecent Exposure is a much more serious offense. Finally, a lewd fondling or caressing of someone else’s body in public could also be indecent behavior.

What are the Consequences for a Conviction of Public Indecency in Parker, Colorado?

The consequences for Public Indecency are usually a class 1 petty offense. This means that you could be facing up to 6 months in the Douglas County Detention Center. It also carries a fine of up to $500.00. However, there is one section of the Colorado law that allows for a conviction of a class 1 misdemeanor. If you are charged with a second offense of a specific act outlawed by the Law, then you would be looking at more severe penalties. The maximum punishment in that scenario is up to 18 months in jail and up to a $5,000.00 fine.

Do I have to Register as a Sex Offender for a Public Indecency Conviction in Colorado?

Most convictions for indecent public behavior do not require registration in Colorado. For example, if you are convicted of having sex in public, you would not have to register as a sex offender. Still, there are some scenarios where you could be forced to register. Typically, a person who is twice convicted for exposing his genitals to the view of another person could be have to be listed on the Sex Offender searches. The only way to truly know whether that applies to your case is to contact our criminal attorneys to help you. Further, we will fight the charges you are facing to be able to avoid any additional consequences.
